PickMyCar USA LLC Privacy Policy

PickMyCar USA LLC ("PickMyCar USA") provides this policy with respect to privacy (“Privacy Policy”) as a guide to the nature of using the PickMyCar USA Site and PickMyCar USA Service. If you do not agree to this Privacy Policy, then you should not use the PickMyCar USA Site or PickMyCar USA Service. This Privacy Policy is as referenced in the PickMyCar USA Terms of Service. Any capitalized terms used and not defined herein shall be defined as set forth in the PickMyCar USA Terms of Service. If you provide any content to the PickMyCar USA Site or PickMyCar USA Service, such content shall be subject to this Privacy Policy and the Terms of Service; provided, however, this Privacy Policy does not apply to any entities not under the ownership or control of PickMyCar USA or to individuals not employed or managed by PickMyCar USA (e.g., any third party to which PickMyCar USA may disclose user information as set forth in this Privacy Policy). Any Data Submissions or other information used in connection with the PickMyCar USA Service becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

1. Privacy Policy Changes

PickMyCar USA may revise this Privacy Policy in its sole discretion. If any such changes are made, PickMyCar USA will endeavor to notify you of any such changes (e.g., a general notification via the PickMyCar USA Service to all users). If you disagree with any such modifications, then you can stop using the PickMyCar USA Site and PickMyCar USA Service pursuant to the Terms of Service.

2. The Information PickMyCar USA Collects

In connection with the PickMyCar USA Service, PickMyCar USA may obtain the below information:

A. User Provided Information:

You will provide information to PickMyCar USA, which may include your name, username, phone number, billing information and device information. The foregoing information may be provided in deciding to participate in various uses of the PickMyCar USA Service (e.g., registering as a user, updating your data or requesting data for your contacts). If you provide any of the foregoing information regarding another user, then you must be authorized to submit such information on such individual’s behalf.

B. Content:

PickMyCar USA may collect and store content in connection with the PickMyCar USA Service (e.g., history, archiving, and compliance).

C. Cookies Information:

When you visit the PickMyCar USA Site, PickMyCar USA may send one or more cookies to your computer that uniquely identifies your browser.

D. Log File Information:

In connection with the PickMyCar USA Service, PickMyCar USA may log certain general information such as whenever a message is sent or received or with respect to your updates or requests for information, including time and date stamps and applicable phone numbers. In connection with the use of the PickMyCar USA Site, PickMyCar USA may record information when you visit a website via your web browser (e.g., your IP address, web search, the default language setting of the browser, the browser type, the last and next sequential URLs visited, the date and time of your request, nature of clicks, cookies that may uniquely identify your browser, applicable phone numbers, and other related information or data).

3. The Way PickMyCar USA Uses Information

If you submit information to PickMyCar USA through the PickMyCar USA Site, or PickMyCar USA Service, then PickMyCar USA may use your personal information to run, maintain, and customize the PickMyCar USA Site and PickMyCar USA Service. Any information or Data Submissions that you voluntarily disclose on the PickMyCar USA Service becomes available and may be collected and used by other users of the PickMyCar USA Service. PickMyCar USA may use your information (e.g., anonymous user usage data, cookies, IP addresses, browser type, and other information) to advance and customize the PickMyCar USA Site and PickMyCar USA Service including with new features and functionalities. PickMyCar USA may use cookies and log file information to: (a) remember information (e.g., for purposes of your convenience in the use of the PickMyCar USA Site); (b) customize content, information, and display; and (c) track relevant data metrics.

4. When PickMyCar USA Discloses Information and Third Party Marketers

In the maintenance and improvement of the PickMyCar USA Service, PickMyCar USA may share your information with third party service providers. For purposes of assisting relevant third-parties with any advertisements, promotions or other third-party run functionalities in connection with the PickMyCar USA Site, PickMyCar USA may also share non-personally-identifiable information (e.g., anonymized data) with such third-parties. PickMyCar USA may collect and release information in the good-faith belief that such action is necessary to comply with applicable laws (e.g., U.S. copyright law), including a court order, subpoena, or search warrant or equivalent, or if an individual’s safety may be at issue (as determined by PickMyCar USA’ reasonable belief). PickMyCar USA also may disclose such information in connection with government investigations and enforcement actions, to enforce the Terms of Service, to defend itself from third-party claims or otherwise limit its liability, to maintain the security of the PickMyCar USA Site, and to otherwise protect the rights, property, and/or personal safety of PickMyCar USA, users, or others. With respect to information and/or Data Submissions obtained in the delivery of the PickMyCar USA Service (e.g., in accordance with Section 2 of this Privacy Policy), PickMyCar USA, its affiliates, and assignees shall have an unrestricted right to use your information in concert with or as third party marketers both within and outside of the scope of the provision of the PickMyCar USA Service.

5. Your Choices

You may decline to submit select information through the PickMyCar USA Site or the PickMyCar USA Service, and PickMyCar USA may not be able to provide certain services to you. If you do not agree with the Privacy Policy or Terms of Service of PickMyCar USA, you may delete your account, uninstall the PickMyCar USA software and discontinue use of the PickMyCar USA Service; if you continue to use the PickMyCar USA Service, you are expressly agreeing to this Privacy Policy and Terms of Service via such use. Please contact PickMyCar USA via the PickMyCar USA Site with any questions or comments about this Privacy Policy and your information.

6. Transmission of Data

PickMyCar USA uses commercially reasonable efforts to secure its systems. However, PickMyCar USA cannot ensure the security of any information you transmit to PickMyCar USA and you do so at your own risk, and you should not use unsecured internet access or other unprotected networks to submit messages through the PickMyCar USA Service. If PickMyCar USA learns of a security systems breach, then it may attempt to notify you electronically so that you can take appropriate protective steps (e.g., PickMyCar USA may post a notice on the PickMyCar USA Site or through the PickMyCar USA Service if a security breach occurs).

7. Children’s Information

PickMyCar USA Service is not directed to minors less than 16 years of age and minors less than 16 years of age may not use the PickMyCar USA Service. Please contact PickMyCar USA if you learn that a minor under 16 years of age has provided information to PickMyCar USA.

8. Law

The privacy policy is governed by, and must be interpreted in accordance with, the laws of United States of America. Each party submits to the non-exclusive jurisdiction of the Courts of United States of America in relation to any dispute connected with the Agreement.

9. Compliance with Law

You agree not to use the PickMyCar USA Service in a manner that would violate applicable laws protecting an individual’s privacy rights, health or financial data .

10. Assignment

An assignment may occur as part of a merger or acquisitions, asset transfers, sales, or other change of control (as well as in a bankruptcy, including in an assignment for the benefit of creditors). In connection with the assignment of the Terms of Service and this Privacy Policy, PickMyCar USA may also transfer or assign the information collected from its users.
